Terms and Conditions for Users

1. This document contains very important information regarding your rights and obligations, as well as conditions, limitations, and exclusions that might apply to you. Please read it carefully.
These terms may require the use of arbitration on an individual basis to resolve disputes, rather than jury trials or class actions.
These terms govern the publication (“Listing”) of items for rent (“Items”). By renting and/or listing Items through this website (and therefore becoming a “User”), you affirm that you are of legal age to enter into this agreement, and you accept and are bound by these terms and conditions. You affirm that if you are renting or listing on behalf of an organization or company, you have the legal authority to bind any such organization or company to these terms and conditions.
You may not rent or list Items through this website if you (a) do not agree to these terms, (b) are not the older of (i) at least 18 years of age or (ii) legal age to form a binding contract with RNTR or (c) are prohibited from accessing or using this website or any of this website's contents, goods or services by applicable law.
These terms and conditions (these "Terms") apply to the rental of Items and services through RNTR.com and the RNTR app (the "Site"). These Terms are subject to change by RNTR (referred to as "us", "we", or "our" as the context may require) without prior written notice at any time, in our sole discretion. Any changes to the Terms will be in effect as of the "Last Updated Date" referenced on the Site. You should review these Terms before renting or listing any Items through this Site. Your continued use of this Site after the "Last Updated Date" will constitute your acceptance of and agreement to such changes.
These Terms are an integral part of the website that apply generally to the use of our Site. You should also carefully review our Privacy Policy before listing or requesting a rental for Items through this Site (see Section 25).
Renter Terms

2. Renting

When you (a “Renter”) rent an Item (each, a “Rental”), you are agreeing to pay all charges for your Rental including the Rental price, applicable fees like RNTR’s service fee, taxes, and any other items identified during checkout (collectively, “Total Price”). When you receive the Rental confirmation, a contract for the Rental is formed directly between you and the individual listing the Item (a “Listing Individual”). In addition to these Terms, you will be subject to, and responsible for complying with, all terms of the Rental, including without limitation, the cancellation policy and any other rules, standards, policies, or requirements identified in the Listing or during checkout that apply to the Rental. It is your responsibility to read and understand these rules, standards, policies, and requirements prior to requesting a Rental.
3. Your Responsibilities
You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you provide access to Items rented from the Site. For example, this means: (i) you are responsible for leaving an Item in the condition it was in when it was provided to you; (ii) you are responsible for paying all damage claim amounts necessary to cover damage that you cause to an Item; and (iii) you must act with integrity, treat others with respect and comply with applicable laws at all times. If you are renting an Item on behalf of or for use by an individual is a minor, you must be legally authorized to act on behalf of the minor and you are solely responsible for the supervision of that minor.
4. Renter Representations and Warranties
(a) By renting one or more Items, you represent and warrant that you have adequate knowledge and experience to rent and operate each Item competently and safely. In addition, you represent and warrant that you will use all applicable safety devices and equipment including but not limited to safety goggles, glasses or other types of eye protection (including prescription lenses and frames when required), helmets, vests, gloves, ear plugs, life preservers, and appropriate footwear (such as closed toed or non-slip shoes), as applicable and appropriate to the use of the Item.
(b) By renting one or more Items, you represent and warrant that you will use each Item only for its intended purposes and will not modify an Item in any way.
5. Cancellations, Refunds, and Modifications
(a) In general, if you cancel a Rental, the amount refunded to you is determined by the cancellation policy that applies to that Listing. If the Listing Individual cancels a Rental, you may be entitled to a partial or full refund at the discretion of RNTR.
Refunds are processed within approximately three business days of our receipt of your refund request. Your refund will be credited back to the same payment method used to make the original purchase on the Site.
(b) Listing Individuals and Renters are responsible for any Rental modifications they agree to make via the RNTR platform or direct RNTR customer service to make on their behalf (“Rental Modifications”) and agree to pay any additional amounts, fees or taxes associated with any Rental Modification.
6. Manufacturer's Warranty and Disclaimers
We do not manufacture or control any of the Items offered on our Site. The availability of Items through our Site does not indicate an affiliation with or endorsement of any product, service, or manufacturer. Accordingly, we do not provide any warranties with respect to the Listings on our Site.
All Listings on this site are provided “as is” without any warranty whatsoever, including, without limitation, any (a) warranty of merchantability; (b) warranty of fitness for a particular purpose; or (c) warranty against infringement of intellectual property rights of a third party; whether express or implied by law, course of dealing, course of performance, usage of trade, or otherwise.
Some jurisdictions limit or do not allow the disclaimer of implied or other warranties so the above
disclaimer may not apply to you.
Listing Individual Terms
7. Contracting with Renters
When you accept a Rental request or receive a Rental confirmation through the Site, you are entering into a contract directly with the Renter, and are responsible for delivering the Item under the terms and at the price specified in your Listing. You are also agreeing to pay applicable fees like RNTR’s service fee and applicable taxes for each booking. RNTR will deduct amounts you owe from your payout unless we and you agree to a different method. Any terms or conditions that you include in any supplement contract with Renters must be consistent with these terms, the information provided in your Listing, and be prominently disclosed in your Listing description.
8. Independence of Listing Individuals
Your relationship with RNTR is that of an independent individual or entity and not an employee, agent, joint venture, or partner of RNTR. RNTR does not direct or control your Listing and you understand that you have complete discretion whether and when to provide Items and at what price and on what terms to offer them.
9. Your Responsibilities
You are responsible for your own acts and omissions and are also responsible for the acts and omissions of anyone you allow to participate in providing your Items. You are responsible for setting your price and establishing rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the RNTR platform except those expressly authorized. Do not encourage Renters to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the RNTR platform.
10. Listing Individual Representations and Warranties
(a) By listing one or more Items through the Site, you represent and warrant that each Item is in good working condition, fit for its intended purposes, and that it has been adequately maintained and is unaltered. In doing so, you represent and warrant that no safety devices original to an Item have been modified, disabled, or otherwise altered.
11. Cancellations and Rental Modifications
(a) In general, if a Renter cancels a Rental, the amount paid to you is determined by the cancellation policy that applies to that Rental. As a Listing Individual, you should not cancel on a Renter without a valid reason under RNTR’s discretion or applicable law. If you cancel on a Renter without such a valid reason, we may impose a cancellation fee and other consequences.
(b) Listing Individuals and Renters are responsible for any Rental Modifications they agree to make via the RNTR platform or direct RNTR customer service to make on their behalf, and agree to pay any additional amounts, fees or taxes associated with a Rental Modification.
12. Taxes
As a Listing Individual, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit or include in your price any applicable VAT or other indirect taxes, occupancy taxes, income or other taxes (‘Taxes”).
13. Tax Information
In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that RNTR may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Listings to facilitate accurate tax reporting by our Renters and their organizations.
General Terms
14. Rental Agreement
Rental Agreement. Prior to renting, as either a Listing Individual or Renter, a User must enter into a direct user agreement between the Listing Individual and the Renter facilitated through the Site (each, a “Rental Agreement”). RNTR will provide a sample agreement for the use of the Users, and Listing Individuals may alternatively upload their own Rental Agreements.
In signing a Rental Agreement, the Renter authorizes RNTR to charge any costs, fees (including but not limited to cleaning fees), or damages pursuant to a Rental Agreement. Thereafter, RNTR shall pay the charge to the Listing Individual less a processing fee which will be retained by RNTR.
15. Content
Parts of the RNTR platform enable you to provide feedback, text, photos, audio, video, information and other content (“Content”). By providing Content, in whatever for and through whatever means, you grant RNTR a non-exclusive, worldwide, royalty-free, sublicensable and transferable license, for the term of the protection of the rights so licensed, to access, use, store, copy, modify, prepare derivative works of, distribute, publish, transmit, stream, broadcast, and otherwise exploit in any manner such Content to provide and/or promote the RNTR platform, in any media or platform, known or unknown to date and in particular on the internet and social networks. If Content includes personal information, such Content will only be used for these purposes if such use complies with applicable data protection laws in accordance with our Privacy Policy. Where RNTR pays for the creation of Content or facilitates its creation, RNTR may own that Content, in which case supplemental terms or disclosures will say that. You are solely responsible for all Content that you provide and warrant that you either own it or are authorized to grant RNTR the rights described in these Terms. You are responsible and liable if any of your Content violates or infringes the intellectual property or privacy rights of any third party. Content must comply with our Content Policy and Nondiscrimination Policy, which prohibit, among other things, discriminatory, obscene, harassing, deceptive, violent and illegal content. You agree that RNTR may make available services or automated tools to translate Content and that your Content may be translated using such services or tools. RNTR does not guarantee the accuracy or quality of translations and Users are responsible for confirming the accuracy of such translations.
16.Fees
RNTR may charge fees (and applicable Taxes) to Listing Individuals and Renters for the right to use the RNTR platform. Any applicable fees are disclosed to Listing Individuals before publishing a Listing and to Renters before booking a Rental. Except as otherwise provided on the RNTR platform, service fees are non-refundable.
17. Prohibited Items
RNTR, in its sole and absolute discretion and at any time, may prohibit the listing of any Item.
18. Rules

(v) Do not request, make or accept a booking or any payment outside of the RNTR platform to avoid paying fees, taxes or for any other reason.
(vi) Do not require or encourage Renters to open an account, leave a review, or otherwise interact, with a third party website, application or service before, during or after a Rental, unless authorized by RNTR.

(v) Do not use or register any domain name, social media handle, trade name, trademark, branding, logo or other source identifier that may be confused with RNTR branding.
(vi) Do not offer or solicit prostitution or participate in or facilitate human trafficking.
19. Reporting Violations
If you believe that a User, Listing or Content poses an imminent risk of harm to a person or property, you should immediately contact local authorities before contacting RNTR. In addition, if you believe that a User, Listing or Content has violated our Rules, you should report your concerns to RNTR. If you reported an issue to local authorities, RNTR may request a copy of that report. Except as required by law, we are not obligated to take action in response to any report.
20. User Violations
User Violations. If (i) you breach these Terms (ii) you violate applicable laws, regulations or third party rights, (iii) you have repeatedly received poor reviews or RNTR otherwise becomes aware of or has received complaints about your performance or conduct, (vi) you have repeatedly cancelled confirmed Rentals or failed to respond to Rental requests without a valid reason, or (vii) such action is necessary to protect the personal safety or property of RNTR, its Users, or third parties, RNTR may: (a) suspend or limit your access to or use of the RNTR platform and/or your account; (b) suspend or remove Listings, Reviews, or other Content; (c) cancel pending or confirmed bookings; or (d) suspend or revoke any special status associated with your account
21. In case of non-material violations or where otherwise appropriate, you will be given notice of any intended measure by RNTR and an opportunity to resolve the issue, unless such notification would (i) prevent or impede the detection or prevention of fraud or other illegal activities, (ii) harm the legitimate interests of other Users or third parties, or (iii) contravene applicable laws.
22. Legal Mandates
RNTR may take any action it determines is reasonably necessary to comply with applicable law, or the order or request of a court, law enforcement or other administrative agency or governmental body, including the measures described above in Section 21.
23. Effect of Termination
If you are a Listing Individual and terminate your RNTR account, any confirmed booking(s) will be automatically cancelled and your Renters will receive a full refund. If you terminate your account as a Renter, any confirmed booking(s) will be automatically cancelled and any refund will depend upon the terms of the Listing’s cancellation policy. When this agreement has been terminated, you are not entitled to a restoration of your account or any of your Content. If your access to or use of the RNTR platform has been limited, or your RNTR account has been suspended, or this agreement has been terminated by us, you may not register a new account or access or use the RNTR platform through an account of another User.
24. Limitation of Liability
In no event shall we be liable to you or any third party for consequential, indirect, incidental, special, exemplary, punitive or enhanced damages, lost profits or revenues or diminution in value, arising out of, or relating to, and/or in connection with any breach of these terms, regardless of (a) whether such damages were foreseeable, (b) whether or not we were advised of the possibility of such damages and (c) the legal or equitable theory (contract, tort, or otherwise) upon which the claim is based.
Our sole and entire maximum liability, for any reason, and your sole and exclusive remedy for any cause whatsoever, shall be limited to the actual amount paid by you for the Rental you have ordered through our site.
The limitation of liability set forth above shall: (i) only apply to the extent permitted by law and (ii)] not apply to (A) liability resulting from our gross negligence or willful misconduct and (B) death or bodily injury resulting from our acts or omissions.
25. Privacy
Privacy. We respect your privacy and are committed to protecting it. Our Privacy Policy, [WEBSITE ADDRESS], governs the processing of all personal data collected from you in connection with your Rental or Listing of Items through the Site.
26. Force Majeure
We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
27. Governing Law and Jurisdiction
This Site is operated from the US. All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the State of Minnesota without giving effect to any choice or conflict of law provision or rule (whether of the State of Minnesota or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of Minnesota.
28. Damage Claims.
If a User provides valid evidence that you culpably damaged the complaining User’s personal property, or real or personal property the complaining User is responsible for, including consequential damages, ("Damage Claim"), the complaining User can notify RNTR support and/or seek compensation. You will be notified of the Damage Claim and given an opportunity to respond. If you agree to pay, you authorize RNTR to collect the amount of the Damage Claim from you.
(a) If the Listing Individual and Renter cannot resolve, or a User fails to pay a Damage Claim, the Listing Individual may notify RNTR support and seek compensation. RNTR will review the Damage Claim and ask the Listing Individual to provide any required evidence (e.g. through appropriate documents, photos, invoices, or third-party experts) which substantiates the Damage Claim and the Damage Claim amount. The Renter will be given the opportunity to respond and provide any relevant counter-evidence. If RNTR determines, under consideration of the evidence provided, and applicable statutory rules on the burden of proof that the Renter is responsible for the Damage Claim, RNTR will pay out the Damage Claim to the Listing Individual. If RNTR pays out the Damage Claim to the Host, RNTR may collect the amount of the
Damage Claim from the Renter, including by charging the Renter’s Payment Method up to a maximum amount of $500 USD. RNTR may also pursue claims for recovering Damage Claims amounts, including amounts exceeding the maximum amount applicable for charging the Renter’s Payment Method, against a Renter using any remedies it may have available under applicable law, including referral of the matter to
a collections agency, and/or pursuit of available causes of action and/or claims against a Renter. Users may appeal a decision by RNTR by contacting our customer service. As between Users and RNTR, the burden of proof regarding the Damage Claim and the Damage Claim amount always lies with RNTR.
(b) You agree to cooperate in good faith, provide any information RNTR requests, execute documents, and take further reasonable action, in connection with Damage Claims, User complaints, claims under insurance policies, or other related claims.
(c) Any decisions made by RNTR in relation to a Damage Claim do not affect your contractual and statutory rights. Your right to take legal action before a court of law remains unaffected.
29. Dispute Resolution and Binding Arbitration.
(a) You and RNTR are agreeing to give up any rights to litigate claims in a court or before a jury, or to participate in a class action or representative action with respect to a claim. Other rights that you would have if you went to court may also be unavailable or may be limited in arbitration. Any claim, dispute, or controversy (whether in contract, tort, or otherwise, whether pre-existing, present, or future, and including statutory, consumer protection, common law, intentional tort, injunctive and equitable claims)
between you and us arising from or relating in any way to your Rental or Listing of Items through the site, will be resolved exclusively and finally by binding arbitration. (b) The arbitration will be administered by the American Arbitration.Association ("AAA") in accordance with the Consumer Arbitration Rules (the "AAA Rules") then in effect, except as modified by this Section 29. (The AAA Rules are available at www.adr.org/arb_med or by calling the AAA at 1-800-778-7879.) The Federal Arbitration Act will govern the interpretation and enforcement of this section. The arbitrator will have exclusive authority to resolve any dispute relating to arbitrability and/or enforceability of this arbitration provision, including any unconscionability challenge or any other challenge that the arbitration provision or the agreement is void, voidable, or otherwise invalid. The arbitrator will be empowered to grant whatever relief would be available in court under law or in equity. Any award of the arbitrator(s) will be final and binding on each of the parties and may be entered as a judgment in any court of competent jurisdiction. If you prevail on any claim that affords the prevailing party attorneys' fees, the arbitrator may award reasonable fees to you under the standards for fee shifting provided by law. (c) You agree to an arbitration on an individual basis. In any dispute, neither you nor RNTR will be entitled to join or consolidate claims by or against other customers in court or arbitration or otherwise participate in any claim as a class representative, class member or in a private attorney general capacity. The arbitral tribunal may not consolidate more than one person's claims and may not otherwise preside over any form of a representative or class proceeding. The arbitral tribunal has no power to consider the enforceability of this class arbitration waiver and any challenge to the class arbitration waiver may only be raised in a court of competent jurisdiction. If any provision of this arbitration agreement is found unenforceable, the unenforceable provision will be severed, and the remaining arbitration terms will be enforced.
30. Assignment
You will not assign any of your rights or delegate any of your obligations under these Terms without our prior written consent. Any purported assignment or delegation in violation of this Section 30 is null and void. No assignment or delegation relieves you of any of your obligations under these Terms.
31. No Waivers
The failure by us to enforce any right or provision of these Terms will not constitute a waiver of future enforcement of that right or provision. The waiver of any right or provision will be effective only if in writing and signed by a duly authorized representative of RNTR.
32. No Third-Party Beneficiaries
These Terms do not and are not intended to confer any rights or remedies upon any person other than you.
33. Notices.
(a) To You. We may provide any notice to you under these Terms by (I) sending a message to the email address you provide or (ii) by posting to the Site. Notices sent by email will be effective when we send the email and notices we provide by posting will be effective upon posting. It is your responsibility to keep your email address current. (b) To Us. To give us notice under these Terms, you must contact us as
follows: by personal delivery, overnight courier, or registered or certified mail to [NAME AND ADDRESS]. We may update the facsimile number or address for notices to us by posting a notice on the Site. Notices provided by personal delivery will be effective immediately. Notices provided by facsimile transmission or overnight courier will be effective one business day after they are sent. Notices provided by registered or certified mail will be effective three business days after they are sent.
34. Severability
If any provision of these Terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
35. Entire Agreement

These Terms, the license agreement relating to any Item you obtain or list on or through this Site, and our Privacy Policy will be deemed the final and integrated agreement between you and us on the matters contained in these Terms.
